Car accidents in which alcohol or drugs were a contributing factor continue to plague our roadways in Multnomah County and across the country. It seems that almost daily there is a news report of yet another drunk driving accident or DWI arrest. When a newspaper article reports that an auto accident claimed the life of an individual suspected of driving under the influence, many feel it is a senseless tragedy. But when that accident also leaves innocent victims injured, those affected are left with unanswered questions.
On a September Sunday at about 2 a.m., a 29-year-old woman lost her life when she ran a red light heading eastbound on Oregon 213. She collided with a Dodge pickup truck. The 58-year-old male truck driver was uninjured. The woman who ran the red light was declared dead at the scene and her passenger was rushed to Oregon Health and Science Hospital. According to the news story, the passenger was seriously injured. Police indicate alcohol was a factor in the car accident and their investigation is continuing.
It is unclear whether the passenger will survive her injuries. Oregon law specifically provides that persons injured due to the negligent or reckless conduct of another may recover monetary damages for their injuries and pain and suffering. When the conduct is determined to be reckless as well, punitive damages are allowed.
