Previous posts on this blog have talked about the dangers highway construction workers face as they dedicate themselves to improving the highways and other roads of the Portland metropolitan area.

Despite continued warnings and enforcement efforts, the sad reality is that many drivers in Oregon will simply not heed these warnings and will continue to rush through construction zones or, at a minimum, just not pay the extra attention that is required when navigating a work site.

A driver who rushes or who does not pay attention in these circumstances is prone to hit a highway worker who is just doing his or her job. As has been seen, these sorts of accidents remain too common on Oregon’s roads.

Should a worker get struck by a passing motorist, it will be necessary for that worker to take several legal steps in order to get compensation for his or her injuries. Our law office is equipped to handle this office on these victims’ behalves so that they may focus on their recovery and on rebuilding their lives.

First, the worker generally can file for workers’ compensation benefits. If the system is working as it should, this will give the victim relatively quick access to funds that will cover the victim’s medical bills and related expenses.

A successful workers’ compensation claim will also cover a substantial portion of the victim’s lost wages. Our office can help a worker file and prosecute a claim for these benefits. Should there be any controversies, we will advocate for our clients’ interests.

Additionally, it may be prudent of the worker also to file personal injury lawsuit against the motorist who caused the accident. Doing so can allow the worker to cover those expenses for which workers’ compensation will not pay. Additionally, non-economic damages may be available.
