Our Recent Workers Compensation Victories

RECENT VICTORIES:

We help workers every day. Here are a few examples:

Overuse of arms, hands, and shoulders causing carpel tunnel and rotator cuff tendonitis, found compensably related to constant arm motion at work testing printer boards. On August 14, 2006, Steven won a case for an employee of Merix Corp., who developed overuse syndrome of her hands and arms from inspecting printer boards. Liberty NW fought the case very hard, but in the end, the injured worker prevailed.

Steven had a similar victory in July, where a manufacturer worker also developed overuse injuries in the shoulder requiring shoulder surgery. If workers perform the same activity hundreds of times per day, it can lead to injury.

In May, Steven successfully proved that a dental hygienist's elbow condition was caused by work. SAIF Corp. argued that the injury was caused by her age and genetics, a typical insurance argument. The court did not buy it!

In the spring of 2006, Steven won a case for a union shop steward at Multnomah County who was injured at a seminar designed to help her better deal with her employer in union bargaining sessions. The judge found that because the employer benefited from her attendance at the union sponsored meeting, her injury was work-related. The employer has appealed.

Also, in 2006, Steven won a case for a 20-plus year veteran Tri-met bus driver who developed a serious degenerative neck condition as a result of multiple bus wrecks and constant neck motion of bus driving. The employer appealed to the Court of Appeals and the bus driver prevailed.

Steven has won many cases against Kraft/Nabisco foods, proving its workers routinely sustain overuse injuries. The company now has contacted a medical doctor to review the ergonomics of its processing plant. It's real working folks who make those cookies, not elves!
